    Terms and Conditions – Hotel Bergsonne Allgäu

    For the hotel accommodation contract

    The general terms and conditions for the hotel accommodation contract at Hotel Bergsonne Allgäu, Sonthofen-Imberg.

    1. Scope of Application

    1.1 These terms and conditions apply to contracts for the rental of hotel rooms for accommodation purposes as well as all other services and deliveries provided by the hotel in this context (hotel accommodation contract).

    1.2 Subletting or re-renting of the rooms provided, as well as their use for purposes other than accommodation, requires the prior written consent of the hotel.

    2. Contract Conclusion, Parties

    2.1 The contracting parties are Hotel Bergsonne Allgäu (Sonne Imberg GmbH) and the guest. The contract is concluded upon the hotel's confirmation of the guest's booking. The hotel is free to confirm a room booking.

    2.2 If a third party has booked on behalf of the guest, they are jointly liable to the hotel together with the guest.

    3. Services, Prices, Payment, Deposit

    3.1 The hotel is obliged to keep the rooms booked by the guest available and to provide the agreed services.

    3.2 The guest is obliged to pay the hotel's applicable prices for the room rental and any additional services used.

    3.3 Prepayment principle: Since the hotel does not have a physical reception, the full invoice amount must be paid at the time of booking or at the latest by the cancellation deadline.

    3.4 Prices include the service fee, taxes and local charges applicable at the time of contract conclusion.

    4. Digital Check-in and Access

    4.1 Online check-in: In order to deliver the digital room key by email, the guest is required to complete the digital online check-in before arrival. The arrival information and digital room key will be sent to the direct personal or business email address.

    4.2 If the guest has booked through a booking portal (e.g. Booking.com or Expedia.com), the guest is required to immediately provide the hotel with a direct email address, as arrival information and digital keys are regularly not transmitted by the portals.

    4.3 Access authorization: The digital access code is only activated after complete online check-in and receipt of payment. Passing on the code to unauthorized third parties is prohibited.

    5. Cancellation

    5.1 Withdrawal by the guest from the contract concluded with the hotel is only possible if a right of withdrawal has been expressly agreed in the contract.

    5.2 The following conditions apply to cancellation:

    • Up to 7 days before arrival: Free of charge.
    • After this deadline: 50% of the contract price.
    • No-show: 90% of the contract price.

    5.3 The guest is free to prove that the hotel has suffered no damage or significantly less damage.

    6. Room Provision, House Rules & Safety

    6.1 Booked rooms are available to the guest from 3:00 PM on the agreed arrival day and must be vacated by 11:00 AM at the latest on the departure day.

    6.2 No smoking: All rooms and public areas are strictly non-smoking areas. A cleaning fee of at least €250 will be charged for violations.

    6.3 Parties & Noise: Parties are generally prohibited. The hotel reserves the right to use decibel meters (without audio recording). In case of noise disturbance, a paid security service may be engaged or the accommodation contract terminated without notice.

    7. Hotel Liability

    7.1 The hotel is liable for damages caused by injury to life, body or health for which it is responsible.

    7.2 The hotel is liable to the guest for items brought in according to legal provisions (§§ 701 ff. BGB). Since no reception is staffed, it is strongly recommended not to leave valuables unattended in the room.

    7.3 Liability for failure of digital infrastructure (WiFi, locking system) is limited to intent and gross negligence, provided that immediate rectification by support has been initiated.

    8. Final Provisions

    8.1 Changes or additions to the contract must be made in writing.

    8.2 The place of performance and payment is the hotel's registered office. German law applies.

    8.3 The hotel does not participate in dispute resolution proceedings before consumer arbitration bodies.
